1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and SwagHatz ("we," "us," or "our") governing your access to and use of the website swaghatz.net (the "Site"), including any purchase of our products and participation in our SMS/text messaging program.

By accessing the Site, placing an order, or submitting a form, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to make a purchase from the Site. By using the Site, you represent that you meet this requirement and that all information you provide is accurate and complete.

3. Products & Orders

• Handcrafted products. Our hats are handmade and made to order. Slight variations in color, texture, and detailing are natural characteristics of handcrafted goods and are not defects.
• Custom orders. Custom and one-of-one builds are produced to your specifications. Please review your design details carefully before confirming, as custom orders cannot be changed once production begins.
• Order acceptance. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or product unavailability. If we cancel a paid order, you will receive a full refund.
• Pricing. All prices are listed in U.S. dollars and are subject to change without notice. Applicable taxes and shipping fees are calculated at checkout.

4. Payment

Payment is due in full at the time of purchase unless otherwise agreed in writing. Payments are processed by secure third-party payment processors. By submitting payment information, you represent that you are authorized to use the payment method provided.

5. Shipping & Delivery

We ship nationwide. Estimated production and delivery timeframes are provided at the time of order and may vary for custom builds. We are not responsible for delays caused by shipping carriers, weather, or events outside our reasonable control. Risk of loss passes to you upon our delivery of the product to the carrier.

6. Returns, Exchanges & Refunds

• Custom and made-to-order items are final sale and non-refundable, except where the item arrives damaged or materially different from what was ordered.
• Damaged or incorrect items must be reported within 7 days of delivery with photos to [email protected]. We will repair, replace, or refund at our discretion.
• Any approved refund will be issued to the original payment method.

7. SMS/Text Messaging Terms

SwagHatz offers an SMS/text messaging program for order updates, customer care, and promotional offers. By providing your mobile phone number and checking the SMS consent box on our forms, you expressly agree to receive recurring automated and non-automated text messages from SwagHatz at the number provided.

• Consent is not a condition of purchase. You can buy from us without joining the SMS program.
• Message frequency varies. The number of messages you receive depends on your orders and interactions with us.
• Message and data rates may apply. Charges are billed by your mobile carrier per your plan.
• Opt-out: reply STOP to any message at any time to unsubscribe. You will receive a one-time confirmation message, after which no further messages will be sent unless you opt back in.
• Help: reply HELP to any message or email [email protected] for support.
• Carriers are not liable for delayed or undelivered messages.
• You represent that you are the account holder of the mobile number you provide, and you agree to notify us promptly if your number changes.

8. Intellectual Property

All content on the Site — including the SwagHatz name, logo, product designs, photographs, text, and graphics — is owned by or licensed to SwagHatz and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.

9. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose;
• Attempt to gain unauthorized access to the Site or its systems;
• Interfere with the Site's operation or security;
• Submit false or misleading information; or
• Use automated tools to scrape or collect data from the Site without permission.

10. Disclaimer of Warranties

The Site and all products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, SwagHatz shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site or products. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

You agree to indemnify and hold harmless SwagHatz and its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site.

13. Governing Law & Disputes

These Terms are governed by the laws of the United States and the state in which SwagHatz is organized, without regard to conflict-of-law principles.
